Using AI to Fight Your Case - a note of caution for Litigants in Person

As a Litigant in Person, you may be tempted to save costs by using AI to fight your case, however, do note that AI is not a lawyer and recent decisions in England and Wales show that courts are encountering AI-related errors in submissions and when they do, the consequences may be quite serious for the Litigant in Person. You are personally liable for what you submit to the court The view of the UK courts is that a party remains responsible for what they put before the court. For example, in Harber v HMRC [2023] UKFTT 1007 (TC), the tribunal dealt with a litigant in person relying on invented judgments and highlighted the wasted time and public resources caused by false authorities. Also, in HMRC v Marc Gunnarsson [2025] UKUT 247 (TCC), the Upper Tribunal said a draft submission referred to three decisions that did not exist. Mr Gunnarsson though did remove them from his final submission after HMRC queried them and the tribunal did not find him highly culpable, but warned that it could consider sanctions in future cases. Additionally, in Elden v HMRC [2026] UKFTT 41 (TC), the litigant represented himself at the hearing, but his representatives had prepared a skeleton argument containing inaccurate AI-assisted case summaries. The tribunal refused HMRC’s strike-out application at that stage, but imposed demanding requirements upon him for future submissions, including copies of judgments, direct quotations with precise references, explanations of relevance and confirmation that the material had been checked. The Lesson for Litigants in Person The practical danger is broader than the issue of fictional case names that may be cited as AI may cite a real case for a proposition it does not support, misstate a statute, omit a procedural requirement or produce an argument that sounds persuasive but does not fit the facts. Then, a judge may spend time checking it; the other side may challenge it; and the litigant may lose credibility or miss the point that actually matters and in the end achieve nothing worthwhile as well as a significant detriment. No one is saying that you should never use AI, or that everyone must retain a lawyer for a whole case as AI can help organise a chronology, identify questions to ask, explain unfamiliar terms or improve plain-language drafting. However, in its current state, it should not be treated as a legal researcher whose output is safe to file unchecked by a lawyer. If you use AI as a Litigant in Person, treat every legal citation as unverified until you have checked the actual judgment and confirmed that it supports the point you are making. Check deadlines and court directions independently and never include a case, quotation or legal proposition merely because a chatbot supplied it. As a Litigant in Person, your aim should not be to spend the least possible on legal help at the start. Rather, it should be to avoid a preventable mistake that makes your case harder and more expensive to put right later.
